PAIA Manual
This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA). It explains what records ASC Pest Control holds and how you may request access to them.

1. Introduction
This manual is compiled in accordance with section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA). PAIA gives effect to the constitutional right of access to information held by the State and by private bodies where that information is required to exercise or protect any right. This manual is intended to help requesters understand what records ASC Pest Control holds and the procedure to follow when requesting access to those records.

4. Guide of the Information Regulator
The Information Regulator has compiled a guide, as contemplated in section 10 of PAIA, on how to use PAIA. The guide is available in each of the official languages and explains how to exercise your rights under the Act. You may obtain the guide from the Information Regulator (South Africa). The contact details of the Information Regulator are published on its official website.
5. Records held by ASC Pest Control
ASC Pest Control holds records in the following broad categories. The listing of a category does not mean that access will automatically be granted, as access is subject to the grounds for refusal in PAIA.
5.1 Company records
- Founding and statutory records maintained under the Companies Act.
- Tax, VAT and financial records maintained under applicable revenue and accounting legislation.
5.2 Client and service records
- Quotations, service agreements and correspondence.
- Inspection findings, treatment records, trend data, service reports and audit packs.
- Records held within the My ASC Pest Hub portal.
5.3 Employee and human resources records
- Employment contracts, training and certification records, and related personnel records.
5.4 Supplier and operational records
- Supplier agreements, product and stock records, and health and safety records.
5.5 Statutory records under other legislation
- Records kept in terms of the Basic Conditions of Employment Act, the Occupational Health and Safety Act, the Income Tax Act, the Value Added Tax Act, the Compensation for Occupational Injuries and Diseases Act, and the relevant pest control and agricultural remedies legislation, to the extent applicable.
6. How to request access to a record
To request access to a record, you must:
- Complete the prescribed request form and submit it to the information officer at the address above.
- Provide sufficient detail to enable us to identify the record and the requester.
- Identify the right you are seeking to exercise or protect, and explain why the requested record is required to exercise or protect that right.
- State the form of access required and give a valid contact address or email in South Africa.
- Pay the applicable request fee and, where relevant, an access fee, as set out below.
7. Prescribed forms and fees
Requests must be made on the prescribed form as published in the regulations to PAIA. The applicable fees are those prescribed from time to time in the PAIA regulations, and may include:
- A request fee payable on submission of a request by a requester who is not seeking access to a record about themselves.
- An access fee to cover the reproduction, search and preparation of records, and any postage where applicable.
- A deposit where the preparation of the record is estimated to require significant time.
The information officer will notify you of the fees payable before granting access, and access may be withheld until the applicable fees are paid.
8. Grounds for refusal
Access to a record may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA. These include the mandatory protection of the privacy of third parties, commercial information of third parties, confidential information, and records privileged from production in legal proceedings, among others.
9. Records available in terms of other legislation
Certain records may be accessed in terms of other legislation, for example records available under the Companies Act or revenue legislation. Where such access is provided for, it may be used instead of a PAIA request.
10. Remedies
If a request for access is refused, or you are dissatisfied with the way a request was handled, you may lodge a complaint with the Information Regulator, or apply to a competent court, as provided for in PAIA. Details of the procedure and time periods are set out in the Act and in the guide of the Information Regulator.
