Terms & Conditions
These terms and conditions set out the basis on which ASC Pest Control quotes for and provides pest control and food safety services. Please read them together with any quotation or service agreement we send you.

1. Parties and definitions
These terms are agreed between ASC Food Safety and Public Health Consultants (Pty) Ltd, trading as ASC Pest Control ("ASC", "we", "us" or "our"), and the client identified in the relevant quotation or service agreement ("you" or "the client"). "Services" means the pest control, monitoring, treatment, fumigation and related food safety services we agree to provide. "Premises" means the site or sites where we provide the services.
2. Scope of services
We provide the services described in our quotation or service agreement. Unless expressly stated in writing, our services do not include structural repairs, proofing works, building works or the correction of underlying conditions that cause pest activity. We may recommend such works, but they remain your responsibility unless we agree otherwise in writing.
Integrated Pest Management aims to reduce and control pest activity to acceptable levels through prevention, monitoring and targeted treatment. Because pests are living organisms influenced by conditions outside our control, we cannot guarantee the permanent absence of any pest.
3. Quotations and pricing
Quotations are based on the information you provide and on our assessment of the premises. Unless stated otherwise, a quotation is valid for the period noted on it and may be revised if the scope, size or condition of the premises differs from what was assessed, or if additional visits or treatments are required.
Prices are quoted in South African Rand. Value Added Tax (VAT) and any travel or after hours charges will be shown or noted where applicable. Recurring programme fees may be reviewed on renewal or with reasonable notice.
4. Service agreements and payment
Recurring services are provided under a service agreement setting out the visit frequency, term and fees. Unless agreed otherwise, invoices are payable within the period stated on the invoice. We reserve the right to suspend services where an account is in arrears, after giving you reasonable notice. Ownership of any devices or monitoring equipment we install remains with us unless expressly sold to you.
5. Client responsibilities
To allow us to provide the services safely and effectively, you agree to:
- Access: provide safe and timely access to all relevant areas of the premises at the agreed times, including any keys, permits or induction we reasonably need.
- Sanitation and housekeeping: maintain good housekeeping and hygiene, manage waste correctly, and address spillages and food debris that attract pests.
- Proofing and maintenance: carry out reasonable proofing, sealing and structural repairs we recommend to exclude pests, and keep the premises in a condition that supports pest control.
- Information: tell us about known pest activity, high risk areas, allergies, sensitive occupants and any site specific hazards.
- Cooperation: follow the reasonable instructions we give before, during and after treatment.
Where pest activity persists because these responsibilities are not met, this may affect the results of the programme and any related recommendations.
6. Safety and re-entry
We apply the least toxic effective approach and target our treatments to reduce risk to people, product and the environment. Some treatments require areas to be vacated for a stated re-entry period, or require food, utensils and sensitive items to be covered or removed. You agree to observe the re-entry times and safety instructions we provide, to keep people and animals out of treated areas as directed, and to communicate these instructions to your staff, occupants and visitors. We are not responsible for loss or harm caused by a failure to follow the safety instructions we give.
7. Product and warranty
We use registered products in line with their approved label directions and applicable legislation. Any service warranty or guarantee that applies will be stated in your quotation or service agreement, and is conditional on you meeting your responsibilities under clause 5. Nothing in these terms limits any right you may have that cannot lawfully be excluded.
8. Limitation of liability
To the extent permitted by law, we are not liable for indirect, consequential or economic loss, including loss of profit, production, stock or business interruption. Our total liability arising from the services is limited, so far as the law allows, to the fees paid for the specific service that gave rise to the claim. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence.
You are responsible for insuring your own premises, stock and property. We are not liable for pre-existing infestations, damage caused by pests before or independently of our services, or loss caused by conditions outside our reasonable control.
9. Cancellation and postponement
If you need to cancel or postpone a scheduled visit, please give us reasonable notice. We may charge a reasonable fee for visits cancelled at short notice, or where our technician is unable to gain access to the premises at the agreed time. Recurring service agreements may be ended by either party on the notice period stated in the agreement.
10. Consumer Protection Act
Where the Consumer Protection Act 68 of 2008 applies to our relationship with you, these terms are to be read subject to that Act. Nothing in these terms is intended to deprive you of any right you have under the Consumer Protection Act, and any provision that conflicts with the Act will apply only to the extent that the Act allows.
11. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, extreme weather, load shedding, civil disruption, epidemics or the failure of third parties.
12. Governing law and jurisdiction
These terms are governed by the laws of the Republic of South Africa. Any dispute arising from these terms or the services will be subject to the jurisdiction of the South African courts. We encourage you to raise any concern with us first so that we can try to resolve it directly.
